Terms of Service

1. Who we are

French Prep is a trade name of Hemnani Investment Advisory B.V. ("we", "us", or "our"), a Dutch private limited company registered at the Netherlands Chamber of Commerce under KvK number 84467819 (RSIN 863222547, VAT NL863222547B01), with registered offices at Eerste Van Swindenstraat 373 A, 1093 GB Amsterdam, the Netherlands. By accessing or using this Platform you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. The service

French Prep is an independently developed, privately operated exam-preparation platform. We provide practice sets, AI-assisted feedback on writing and speaking, and a virtual speaking examiner to help you prepare for the TCF IRN (Test de connaissance du français pour l’intégration, la résidence et la nationalité).

French Prep is not affiliated with, endorsed by, or connected to France Éducation international, the French Interior Ministry, or any government body. We do not administer the official exam. Access to this Platform does not replace taking the official exam. All practice content is independently developed by Hemnani Investment Advisory B.V.

3. Eligibility

You must be at least 18 years old to create an account. By registering you confirm you meet this requirement. We do not knowingly collect data from persons under 16.

4. Account registration

You are responsible for keeping your login credentials confidential and for all activity under your account. You may not share, transfer, or resell your account. Notify us immediately at [email protected] if you suspect unauthorised access.

5. Subscriptions and payment

Full Platform access requires a paid subscription. Prices, plans, and applicable VAT are displayed at checkout and on our pricing section. All amounts are in euros and inclusive of VAT where applicable.

Every plan is billed monthly, with the first month paid at checkout; 6- and 12-month plans set the minimum contract length. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel via My account or by emailing us.

6. Payment processing

Subscription payments are processed by Mollie B.V. (Amsterdam), a licensed payment institution supervised by De Nederlandsche Bank, on behalf of Hemnani Investment Advisory B.V.. "French Prep" appears as the payee at checkout and on your bank statement.

Card and bank details are entered with Mollie and are never stored by French Prep. You can pay by card, Apple Pay or Google Pay; the available methods are shown at checkout.

7. Cancellation and refunds

You may request withdrawal within 14 days after activation while the paid digital content remains unused. Once paid content has been used, the purchase no longer qualifies under our unused-content withdrawal policy.

Starting or opening a paid practice set, revealing paid answers or corrections, or submitting writing or audio for paid assessment constitutes paid use. Merely signing in, viewing billing details, or browsing public pages does not.

Our full cancellation policy — including the withdrawal procedure and the separate rules for stopping monthly or fixed-commitment subscription renewal — is at frenchprep.fr/legal/cancel. That page forms part of these Terms.

8. AI-generated content and no exam result guarantee

Educational content on the Platform, including practice questions, explanations, example answers, and feedback, is partly generated using artificial intelligence and provided "as-is". It may contain inaccuracies, omissions, or outdated information and should not be treated as official France Éducation international guidance.

We make no warranty that using French Prep will result in passing the TCF IRN or reaching a given level. Exam outcomes depend on factors outside our control including your individual preparation, exam-day conditions, and the official scoring criteria. AI feedback on writing and speaking is educational guidance only and does not constitute an official assessment of your French level.

9. Permitted use

You may use the Platform solely for your own personal exam preparation. You may not:

• Share, resell, or sublicense your account or any Platform content
• Reproduce, scrape, or systematically extract content from the Platform
• Use automated tools, bots, or scripts to access or interact with the Platform
• Attempt to reverse-engineer our question banks, AI models, or scoring logic
• Use the Platform for any unlawful purpose or in violation of these Terms

Breach of this clause may result in immediate account suspension without refund.

10. Intellectual property

All content on the Platform — including practice questions, audio materials, software, and design — is the intellectual property of Hemnani Investment Advisory B.V. or its licensors and is protected under Dutch and international copyright law. Nothing in these Terms grants you ownership of any Platform content. You receive a limited, non-exclusive, non-transferable licence to use the Platform for personal exam preparation during your active subscription.

11. User submissions

When you submit writing samples or speaking recordings for AI feedback, you grant Hemnani Investment Advisory B.V. a limited, non-exclusive, royalty-free licence to process that content for the sole purpose of generating feedback for you. We do not use your submissions to train AI models or for any other purpose without your separate consent. Submissions are deleted 90 days after creation unless you delete them sooner.

12. Limitation of liability

To the fullest extent permitted by law, Hemnani Investment Advisory B.V.’s total aggregate liability for any and all claims arising from your use of the Platform shall not exceed the subscription fees you paid in the three calendar months immediately before the event giving rise to the claim.

Hemnani Investment Advisory B.V. is not liable for any indirect, incidental, consequential, or special damages — including loss of data, loss of income, or failure to pass the official exam — even if we were advised of the possibility of such damages.

Nothing in these Terms limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded under mandatory consumer law.

13. Service availability

We provide the Platform on a commercially reasonable basis but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Platform at any time. We will give reasonable advance notice where practicable. We are not liable for interruptions caused by maintenance, third-party infrastructure failures, or events beyond our reasonable control (force majeure).

14. Changes to these Terms

We may update these Terms at any time. For material changes we will notify you by email at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription before the effective date and receive a pro-rated refund for any unused paid period.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without depriving you of the protection of the mandatory consumer law of your country of residence. Any dispute that cannot be resolved informally through our support team shall be submitted to the competent court in Amsterdam, without prejudice to your right as a consumer to bring proceedings in the courts of your place of residence.
